Web Services Terms and Conditions of Use

The ACC Web Services and Tools site ("Site") is owned and operated by the American College of Cardiology Foundation ("ACCF"), 2400 N Street, NW, Washington, DC 20037.

The following terms of use ("TOS") govern the use of the Site by all users of the Site. ACCF reserves the right in its sole discretion to change the TOS from time to time. By accessing or using the Site, you agree to be bound by these TOS and by any amendments in effect at the time of your visit. In addition, all users must affirmatively have agreed to the terms and conditions contained in the Registered User Agreement, which are expressly incorporated into and include these TOS. These TOS also expressly incorporate by reference and include the Cardiosource Privacy Policy and any guidelines, rules or disclaimers that may be posted and updated on specific webpages, or on notices that are sent to you. If you do not agree with these Terms and Conditions, please do not use this Site.

ACCF reserves the right to change, modify, add or remove any part of these terms and conditions and to discontinue or revise any or all aspects of the Site, in its sole discretion at any time and without prior notice. Please check this page periodically for any modifications. Your continued use of this Site following the posting of any changes will mean that you have accepted the changes.

Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

·         modify or copy the materials;

·         use the materials for any commercial purpose unless appropriately licensed;

·         attempt to decompile or reverse engineer any software contained on Site;

·         remove any copyright or other proprietary notations from the materials; or

·         transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by the ACCF at any time without notice.

Neither ACCF, its affiliates, nor any third-party content providers or licensors make any warranty whatsoever, including without limitation, that the operation of the Site will be uninterrupted or error-free; that defects will be corrected; that this Site, including the server that makes it available, is free of viruses or other harmful components; as to the results that may be obtained from use of the Content or other materials on the Site; or as to the accuracy, completeness, reliability, availability, suitability, quality, non-infringement or operation of any Content, product or service provided on or accessible from the Site.

This site and all content, products and services included in or accessible from this site are provided "as is" and without warranties or representations of any kind (express, implied or statutory, including but not limited to the warranties of title and non-infringement and the implied warranties of merchantability and fitness for a particular purpose), all of which ACCF disclaims to the fullest extent permitted by law. Your use of the site is at your sole risk.

The Content on the Site is presented as an educational service intended for licensed healthcare professionals. In no event will ACCF, its affiliates, agents or licensors be liable to you or anyone else for any decision made or action taken by you in reliance on such information. ACCF and its affiliates, agents and licensors shall not be liable to you or anyone else for any damages (including, without limitation, consequential, special, incidental, indirect, or similar damages) even if advised of the possibility of such damages. You agree that the liability of ACCF, its affiliates, agents and licensors, if any, arising out of any kind of legal claim (whether in contract, tort or otherwise) in any way connected with the information provided by ACCF shall not exceed five hundred dollars.

ACCF neither endorses nor takes responsibility for any products, goods or services offered by outside vendors through our services.

Systems Reliability

ACCF endeavors to keep the Site available twenty-four (24) hours a day, seven (7) days a week and to maintain saved information. However, due to technical failures, acts of God or routine maintenance, availability may be limited and/or information may be lost. ACCF shall not be liable for lost information or non-availability of services on the Site.

Intellectual Property Policy

ACCF reserves the right to terminate this Agreement in appropriate circumstances if you infringe upon the intellectual property rights of any third party. Pursuant to the Digital Millennium Copyright Act of 1998, 17 U.S.C. 512(c)(2), ACCF's designated agent for notice of alleged copyright infringement in connection with the Website is:
